Terms & Conditions of Sale

Welcome to Encore Productions. Before proceeding with your booking, please read these Terms and Conditions of Sale carefully. These conditions govern the basis upon which bookings are accepted by Encore Productions. If you do not agree with the following Terms and Conditions of Sale, please refrain from proceeding with your booking.

Encore Productions (referred to as “Encore,” “we,” or “us”) operates as an event ticketing service and is owned and operated by Encore Productions (ABN 77 159 201 993). Encore Productions offers its services for various theatrical and concert events presented by us and our affiliates. When Encore Productions sells a ticket of admission, we warrant that we are fully authorised to sell the ticket(s).

These terms may vary at Encore’s discretion and will be effective upon posting to the website and available to view at the Encore Productions Box Office. You must agree to them, and any current variations to them, each time you make a purchase from us.

No Cancellations, Exchanges, or Refunds:
Once confirmed, bookings may not be cancelled, exchanged, or refunded except as required by law or as detailed in these Terms and Conditions. Encore Productions cannot take responsibility if you do not or cannot attend the performance(s) confirmed in your booking. A contract will be made between Encore Productions and yourself upon confirmation of your booking. Bookings are confirmed when full payment is received. Confirmation of your booking will be sent to the email address provided by you.

Confirmation Email:
For online bookings, an automatic booking confirmation will be sent by email and will include the show times, ticket specifics, and other details of your order. This email will be sent within 60 minutes of payment being received. You must notify Encore Productions immediately if there have been any mistakes with your booking or if you do not receive the confirmation email after an hour.

No Reselling:
No tickets may be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promoting, or other commercial purposes without the express consent of Encore Productions. If a ticket is involved in a breach of this condition, the ticket may be cancelled without a refund, and the bearer of the ticket may be refused admission.

Price Changes:
All prices are subject to change without prior notice until your booking is confirmed.

Refunds for Event Cancellation:
If an event is cancelled or postponed before it begins, we will provide a refund to you. The amount of your refund will depend on the change and cancellation policies of the supplier(s) of the ticket that you bought. If an event is cancelled or postponed after it has commenced, you will not have the right to exchange or receive a refund on tickets.

GST:
All prices quoted include the Goods and Services Tax (GST) where applicable.

Ticketing Code of Practice:
Encore Productions strictly abides by the “Code of Practice for the Ticketing of Live Entertainment in Australia” defined by the industry regulatory association, Live Performance Australia.

Encore Productions Pricing Policy:
All stated prices are inclusive of GST. Encore Productions’ advertised ticket prices include the base supply cost of the products and all fees charged to and by Encore Productions to supply those tickets and packages. All prices are subject to change upon any changes in applicable taxes.

Lost Tickets:
If your allocated seating tickets are lost or stolen, you must produce proof of their original purchase before we will issue a Lost Ticket Voucher. Replacement of lost tickets is subject to the venue and/or promoter’s terms and conditions. Encore Productions may charge an administration fee if a lost ticket voucher needs to be issued. Encore Productions reserves the right not to replace tickets where seating is not allocated (general admission).

Independence:
Encore Productions is an independently owned and operated business. It is not our intention at any point to imply that Encore Productions is endorsed, sponsored, approved, or otherwise affiliated with the presenters or sponsors of any event, except to the extent of being a booking intermediary/agent or as explicitly promoted.

Law & Construction:
These Terms and Conditions of Sale, any contract made by a confirmed booking, and all directly related matters shall be governed and interpreted exclusively under the law and courts of the State of New South Wales, Australia.

Personal Information and Privacy:
In order to make your booking, Encore Productions will need to gather some personal information such as your name, address, and credit card details. Encore Productions will keep your personal information secure and confidential and will not sell your information to any third party. We follow Australia’s privacy laws and our own Privacy Policy in all our dealings with you.

Uncontrollable Events:
Certain events lie outside Encore Productions’ control, and many situations are unavoidable or not reasonably predictable. Except as required by law, Encore Productions is not liable for any loss, inconvenience, damage, additional expense, injury, delay, or any other claim in relation to various uncontrollable events.

Unenforceability:
These Terms are not intended to limit your mandatory legal rights and should be read as such. If any part of these Terms is held to be invalid, illegal, unenforceable, or in conflict with the law of New South Wales, it will be disregarded to the extent of its invalidity, and the remainder will remain in full force and effect.
